Waste electrical equipment – Notification

General information

Notifications about the electrical equipment placed on the market and about the respective waste electrical equipment taken back and/or collected as well as reused and/or recycled waste electrical equipment must be transmitted electronically.

Persons subject to notification obligations

In the Elektroaltgeräteverordnung (EAG-VO) a distinction is made between the following roles:

  • Producers (importers)
These are all those who irrespective of the sales method (including distance selling)
    • Produce and sell electrical or electronic devices under their trade names
    • Sell equipment of other providers under their trade name; the resellers not being considered producers, if the trade name of the producer is applied on the device
    • Import electrical and electronic equipment on a commercial basis to Austria or export it to Austria for the purpose of sale to the final consumer or
    • Sell electrical or electronic equipment in Austria to others than to the final consumer, have their registered office in another EU Member State and have appointed an authorised representative in compliance with the EAG-VO to ensure fulfilment of the obligations arising out of the EAG-VO or
    • Sell electrical or electronic equipment in Austria directly to the final consumer by using the means of distance communication and are established either in another EU Member State or in a third State.
  • Collection and Recovery Systems for Waste Electrical and Electronic Equipment
These are officially approved systems which ensure the collection and recovery of those waste electrical devices for which contracts with producers or importers have been concluded.
  • Operators of Collection Points (collectors of waste electrical equipment)
These are collectors of waste electrical equipment according to section 24a of the Abfallwirtschaftsgesetz (AWG) and in particular operators of municipal collection points.
  • Processors of Waste Electrical Equipment
These are processors for material and thermal recycling and/or disposal.

Deadlines

  • Producers of electrical and electronic equipment for private households
They have to report electronically to the coordinating agency the amounts of electronic equipment placed on the market in Austria in the respective calendar quarter until seven weeks after the expiry of the quarter, if this is not effected by a contracted collection and recovery system.
  • Producers of electrical and electronic equipment for commercial purposes
They must report to the coordinating agency the masses of electrical and electronic equipment placed on the market in Austria in the respective calendar quarter until the 10th of April of each calendar year for the previous calendar year.
  • All producers
They must, for the previous calendar year, report the collected, recycled, and exported masses of waste electrical equipment separated according to collection and processing categories until the 10th of April of each calendar year to the coordinating agency. Furthermore the respective recycling quotas reached shall be indicated.

For each calendar quarter, these must electronically report to the coordination centre a total sum of the masses of electrical and electronic equipment placed on the Austrian market or imported for own use by their participants, broken down by collection and treatment categories, by seven weeks after the end of the quarter to be reported. This report fulfils the respective reporting obligation of the producers participating in this collection and recovery system.
  • All waste collectors (in particular communities or associations of communities) which take over waste electrical or electronic equipment from a final user and don’t give back these devices to the producers. They must report for these devices until the 10th of April of each calendar year on the collected, recycled, and exported waste equipment to the coordinating agency.
  • All waste processors processing waste electrical and electronic devices
They must make the recycling data available to the respective processor and/or collector subject to the reporting obligation until the 10th of March for the previous calendar year.
